Bizim Ap. 5\/7 Daire 12 \/ ModaModa \/ Kad\u0131k\u00f6y \/ \u0130stanbul<br \/><strong>E-mail:<\/strong> <a href=\"mailto:hey@ebruatalay.com\">hey@ebruatalay.com<\/a><\/p><p><strong>MADDE 2- KONU<\/strong><br \/>\u0130\u015fbu s\u00f6zle\u015fmenin konusu,\u00a0<strong>ALICI<\/strong>\u2018n\u0131n\u00a0<strong>SATICI<\/strong>\u2018ya ait \u201c<strong>ebruatalay.com\/performans<\/strong>\u201d internet sitesinden elektronik ortamda sipari\u015fini yapt\u0131\u011f\u0131 a\u015fa\u011f\u0131da nitelikleri ve sat\u0131\u015f fiyat\u0131 belirtilen \u00fcr\u00fcn\u00fcn sat\u0131\u015f\u0131 ve teslimi ile ilgili olarak 4077 say\u0131l\u0131 T\u00fcketicilerin Korunmas\u0131 Hakk\u0131ndaki Kanun ve Mesafeli S\u00f6zle\u015fmeleri Uygulama Esas ve Usulleri Hakk\u0131nda Y\u00f6netmelik h\u00fck\u00fcmleri gere\u011fince taraflar\u0131n hak ve y\u00fck\u00fcml\u00fcl\u00fcklerinin saptanmas\u0131d\u0131r.<\/p><p>\u00a0<\/p><p><strong>MADDE 3- S\u00d6ZLE\u015eME KONUSU \u00dcR\u00dcN<\/strong><br \/>\u00dcr\u00fcnlerin Cinsi ve t\u00fcr\u00fc, Miktar\u0131, Sat\u0131\u015f Bedeli web sitesinde belirtildi\u011fi gibidir.<\/p><p><strong>MADDE 4- GENEL H\u00dcK\u00dcMLER<\/strong><br \/><strong>4.1- ALICI, SATICI<\/strong>\u2019ya ait <strong>ebruatalay.com\/performans<\/strong> internet sitesinde s\u00f6zle\u015fme konusu \u00fcr\u00fcn\u00fcn\/lerin temel nitelikleri, sat\u0131\u015f fiyat\u0131 ve \u00f6deme \u015fekli ile teslimata ili\u015fkin \u00f6n bilgileri okuyup bilgi sahibi oldu\u011funu ve elektronik ortamda gerekli teyidi verdi\u011fini beyan eder.<\/p><p><strong>4.2-<\/strong>\u00a0S\u00f6zle\u015fme konusu \u00fcr\u00fcn, yasal 30 g\u00fcnl\u00fck s\u00fcreyi a\u015fmamak ko\u015fulu ile her bir \u00fcr\u00fcn i\u00e7in ALICI\u2019 n\u0131n yerle\u015fim yerinin uzakl\u0131\u011f\u0131na ba\u011fl\u0131 olarak internet sitesinde \u00f6n bilgiler i\u00e7inde a\u00e7\u0131klanan s\u00fcre i\u00e7inde ALICI veya g\u00f6sterdi\u011fi adresteki ki\u015fi\/kurulu\u015fa teslim edilir.<\/p><p><strong>4.3-<\/strong>\u00a0S\u00f6zle\u015fme konusu \u00fcr\u00fcn, ALICI\u2019dan ba\u015fka bir ki\u015fi\/kurulu\u015fa teslim edilecek ise, teslim edilecek ki\u015fi\/kurulu\u015fun teslimat\u0131 kabul etmemesinden SATICI sorumlu tutulamaz.<\/p><p><strong>4.4- SATICI<\/strong>, s\u00f6zle\u015fme konusu \u00fcr\u00fcn\u00fcn sa\u011flam, eksiksiz, sipari\u015fte belirtilen niteliklere uygun ve varsa garanti belgeleri ve kullan\u0131m k\u0131lavuzlar\u0131 ile teslim edilmesinden sorumludur.<\/p><p><strong>4.5-<\/strong>\u00a0S\u00f6zle\u015fme konusu \u00fcr\u00fcn\u00fcn teslimat\u0131 i\u00e7in i\u015fbu s\u00f6zle\u015fmenin imzal\u0131 n\u00fcshas\u0131n\u0131n\u00a0<strong>SATICI<\/strong>\u2018ya ula\u015ft\u0131r\u0131lm\u0131\u015f olmas\u0131 ve bedelinin\u00a0<strong>ALICI<\/strong>\u2018n\u0131n tercih etti\u011fi \u00f6deme \u015fekli ile \u00f6denmi\u015f olmas\u0131 \u015fartt\u0131r. Herhangi bir nedenle \u00fcr\u00fcn bedeli \u00f6denmez veya banka kay\u0131tlar\u0131nda iptal edilir ise,\u00a0<strong>SATICI<\/strong>\u00a0\u00fcr\u00fcn\u00fcn teslimi y\u00fck\u00fcml\u00fcl\u00fc\u011f\u00fcnden kurtulmu\u015f kabul edilir.<\/p><p><strong>4.6-<\/strong>\u00a0\u00dcr\u00fcn\u00fcn tesliminden sonra\u00a0<strong>ALICI<\/strong>\u2018ye ait kredi kart\u0131n\u0131n\u00a0<strong>ALICI<\/strong>\u2018n\u0131n kusurundan kaynaklanmayan bir \u015fekilde yetkisiz ki\u015filerce haks\u0131z veya hukuka ayk\u0131r\u0131 olarak kullan\u0131lmas\u0131 nedeni ile ilgili banka veya finans kurulu\u015fun \u00fcr\u00fcn bedelini\u00a0<strong>SATICI<\/strong>\u2018ya \u00f6dememesi halinde,\u00a0<strong>ALICI<\/strong>\u2018n\u0131n kendisine teslim edilmi\u015f olmas\u0131 kayd\u0131yla maddi \u00fcr\u00fcn\u00fcn\u00a03 g\u00fcn i\u00e7inde\u00a0<strong>SATICI<\/strong>\u00a0\u2018ya iade etmesi zorunludur. Bu takdirde maddi \u00fcr\u00fcnler i\u00e7in\u00a0nakliye giderleri\u00a0<strong>ALICI<\/strong>\u2018ye aittir.<\/p><p><strong>4.7-<\/strong>\u00a0<strong>SATICI<\/strong>\u00a0m\u00fccbir sebepler veya nakliyeyi engelleyen hava muhalefeti, ula\u015f\u0131m\u0131n kesilmesi gibi ola\u011fan\u00fcst\u00fc durumlar nedeni ile s\u00f6zle\u015fme konusu \u00fcr\u00fcn\u00fc s\u00fcresi i\u00e7inde teslim edemez ise, durumu\u00a0<strong>ALICI<\/strong>\u2018ya bildirmekle y\u00fck\u00fcml\u00fcd\u00fcr. Bu takdirde\u00a0<strong>ALICI<\/strong>\u00a0sipari\u015fin iptal edilmesini, s\u00f6zle\u015fme konusu \u00fcr\u00fcn\u00fcn varsa emsali ile de\u011fi\u015ftirilmesini, ve\/veya teslimat s\u00fcresinin engelleyici durumun ortadan kalkmas\u0131na kadar ertelenmesi haklar\u0131ndan birini kullanabilir.\u00a0<strong>ALICI<\/strong>\u2018n\u0131n sipari\u015fi iptal etmesi halinde \u00f6dedi\u011fi tutar 15 g\u00fcn i\u00e7inde kendisine nakten ve defaten \u00f6denir.<\/p><p><strong>4.8-<\/strong>\u00a018 ya\u015f\u0131ndan k\u00fc\u00e7\u00fck ki\u015filer\u00a0<strong>SATICI<\/strong>\u2018dan al\u0131\u015fveri\u015f yapamaz.<\/p><p><strong>4.9-<\/strong>\u00a0Dizgi ve sistem hatalar\u0131ndan meydana gelen fiyat yanl\u0131\u015fl\u0131klar\u0131ndan\u00a0<strong>SATICI<\/strong>\u00a0sorumlu de\u011fildir.<\/p><p><strong>4.10-<\/strong>\u00a0<strong>SATICI<\/strong>, internet sitesinden sat\u0131\u015f\u0131n\u0131 yapt\u0131\u011f\u0131 t\u00fcm \u00fcr\u00fcnlerin i\u00e7eri\u011fini, kapsam\u0131n\u0131 ve \u00f6zelliklerini de\u011fi\u015ftirme ve iptal etme hakk\u0131na sahiptir.<\/p><p><strong>4.11-<\/strong>\u00a0Sipari\u015fin ger\u00e7ekle\u015fmesi durumunda\u00a0<strong>ALICI<\/strong>\u00a0i\u015fbu s\u00f6zle\u015fmenin t\u00fcm ko\u015fullar\u0131n\u0131 kabul etmi\u015f say\u0131l\u0131r.<\/p><p><strong>MADDE 5- CAYMA HAKKI<\/strong><br \/><strong>ALICI<\/strong>, s\u00f6zle\u015fme konusu \u00fcr\u00fcnlerin kendisine veya g\u00f6sterdi\u011fi adresteki ki\u015fi\/kurulu\u015fa tesliminden itibaren 7 g\u00fcn i\u00e7inde i\u015fbu s\u00f6zle\u015fmesinin 6. Maddesinde belirtilen kurallar dahilinde cayma hakk\u0131na sahiptir. Cayma hakk\u0131n\u0131n kullan\u0131lmas\u0131 i\u00e7in bu s\u00fcre i\u00e7inde\u00a0<strong>SATICI<\/strong>\u2018ya faks, e-posta veya telefon ile bildirimde bulunulmas\u0131 ve \u00fcr\u00fcn\u00fcn 6. madde h\u00fck\u00fcmleri \u00e7er\u00e7evesinde kullan\u0131lmam\u0131\u015f olmas\u0131 \u015fartt\u0131r. Bu hakk\u0131n kullan\u0131lmas\u0131 halinde, 3. ki\u015fiye veya\u00a0<strong>ALICI<\/strong>\u2018ya teslim edilen \u00fcr\u00fcn\u00fcn\u00a0<strong>SATICI<\/strong>\u2018ya g\u00f6nderildi\u011fine ili\u015fkin kargo teslim tutana\u011f\u0131 \u00f6rne\u011fi ile fatura asl\u0131n\u0131n iadesi zorunludur. Bu belgelerin ula\u015fmas\u0131n\u0131 takip eden maddi \u00fcr\u00fcnler i\u00e7in 15 g\u00fcn i\u00e7inde \u00fcr\u00fcn bedeli\u00a0<strong>ALICI<\/strong>\u2018ya iade edilir. Cayma hakk\u0131 nedeni ile iade edilen \u00fcr\u00fcn\u00fcn kargo bedeli\u00a0<strong>ALICI<\/strong>\u00a0taraf\u0131ndan kar\u015f\u0131lan\u0131r.
